McCain hammers Hagel on Iraq troop surge

Republican Sen. John McCain angrily dismissed defense secretary nominee Chuck Hagel as stubbornly camped ?on the wrong side? of history when it comes to Iraq, and he openly doubted whether he could support the confirmation of his former comrade and fellow Republican. The heated exchange between the two men, both decorated Vietnam War veterans, was the most notable in a series of testy verbal duels as Hagel faced some of his fiercest critics in the Senate.

McCain welcomed the former senator by saying he was ?pleased to see an old friend? before the Senate Armed Services Committee, but he immediately ripped into ?the quality of your professional judgment.? (Politico?s David Chalian noted on Twitter that the Arizona lawmaker?s tone suggested that ?old friend? really meant ?ex-friend.?)

McCain, a champion of the troop surge in Iraq, hammered Hagel over his opposition to that escalation of the war and demanded Hagel admit that he was wrong to warn it could turn out to be a Vietnam-level debacle. After labeling Hagel?s concerns ?bizarre? and ?nonsense,? McCain demanded to know whether the nominee stood by his criticisms and asked, ?Were you right or wrong about the surge??

?I stand by 'em because I made 'em,? Hagel replied. ?I would defer to the judgment of history.?

As Hagel offered to ?explain? his remarks, McCain cut him off: ?I want to know whether you were right or wrong. That?s a direct question; I expect a direct answer.?

?The surge assisted in the objective,? Hagel said. ?But if we review the record a little bit ..."

?Will you please answer the question?? McCain jumped in. ?Were you correct or incorrect when you said that the surge would be the most dangerous foreign policy blunder in this country since Vietnam? Were you correct or incorrect? Yes or no?

?Were you right or wrong? That?s a pretty straightforward question,? McCain said.

?I?m not going to give you a yes or no answer,? Hagel said. ?If you would like me to explain why ...?

?No, I actually would like an answer, yes or no,? McCain said, cutting him off.

?I?ll defer that judgment to history,? Hagel repeated. But he added that his Vietnam comments referred to ?the overall war of choice, going into Iraq? and he called the March 2003 invasion ?the most fundamentally bad, dangerous decision since Vietnam.?

?History has already made a judgment about the surge, sir, and you?re on the wrong side of it,? McCain said. ?And your refusal to answer whether you were right or wrong about it is going to have an impact on my judgment as to whether to vote for your confirmation or not.?

?I hope you will reconsider,? McCain said.

Both McCain and Hagel voted in favor of going to war in Iraq, but Hagel later turned sharply against the conflict, often echoing then-Sen. Barack Obama's accusation that the invasion diverted resources from Afghanistan.

Republicans battered Hagel on his past opposition to unilateral economic sanctions against Iran (he has said multilateral sanctions are more effective), and they repeatedly hit him on a report that he co-authored that calls for the elimination of nuclear weapons. He countered that Republican icon Ronald Reagan also favored ridding the world of atomic arsenals, and he insisted that the report was merely suggesting a possible approach, not ?unilateral? disarmament.

Much of the Republican questioning focused on Hagel?s personal policy views, not the Obama administration policies he would be implementing.

Republican Sen. Lindsey Graham of South Carolina zeroed in on Hagel?s contention that the ?Jewish lobby? intimidated American lawmakers into doing dumb things. Under Graham?s pointed questioning, Hagel acknowledged he could not name a specific lawmaker?or a single dumb thing.

Questioned by Republican Sen. Saxy Chambliss of Georgia, Hagel said Iran?s government was ?an elected, legitimate government, whether we agree or not.? (The United States does not have an embassy in Iran, but it negotiates with Tehran as part of six-country talks on that country?s nuclear program. And Washington has repeatedly criticized Iran?s elections as fixed by the country?s religious leadership.)

Confirmation hearings?much like formal debates on the Senate floor?don?t typically change senators? minds. Hagel?s confirmation, or defeat, was being played out behind the scenes as lawmakers measured the likely impact on their political fortunes. It was unclear whether Hagel would lay to rest questions about his views on Israel and Iran.

The Senate confirms Cabinet secretaries by simple majority. But 60 votes are needed if Republicans opt to throw up procedural roadblocks to delay?or kill?the nomination. Democrats, with their independent allies, have a 55-45 advantage in the Senate. To date, the only Republican to come out publicly as a ?yes? vote has been Sen. Thad Cochran of Mississippi.

Earlier, Hagel pleaded with senators not to judge him based on controversial past remarks?like his warning against the ?Jewish lobby??or on single votes he cast during his Senate career.

?No one individual vote, no one individual quote, no one individual statement defines me, my beliefs, or my record,? Hagel said in his opening remarks.

The former senator from Nebraska faces fierce opposition from some Republicans who say he would undermine America?s national security ties to Israel and does not take the threat posed by Iran?s nuclear program seriously enough. Hagel is expected to be confirmed?but not without a fight.

Republican Senate Minority Leader Mitch McConnell told Yahoo News in an exclusive interview on Wednesday that he disagreed with Hagel on a range of issues, but he called Hagel a ?smart, capable guy? who deserves a full hearing. And even some of Hagel's most forceful opponents, like Republican Sen. John Cornyn of Texas, have to date stopped short of vowing to filibuster his nomination.

Sen. Jim Inhofe of Oklahoma, the top Republican on the committee, charged that Hagel would promote "a worldview that is predicated on appeasing our adversaries while shunning our friends" and bluntly called him "the wrong person to lead the Pentagon at this perilous and consequential time."

In his remarks, Hagel took aim directly at some of his critics?and sought to reassure lawmakers who might be on the fence.

?I will ensure our friend and ally Israel maintains its Qualitative Military Edge in the region and will continue to support systems like Iron Dome, which is today saving Israeli lives from terrorists' rocket attacks,? he said.

"I am fully committed to the president?s goal of preventing Iran from obtaining a nuclear weapon, and?as I?ve said in the past, many times?all options must be on the table to achieve that goal," he said, using diplomatic language that refers to the use of military force. "My policy has always been the same as the president?s?one of prevention, and not one of containment?and the president has made clear that is the policy of our government."

Hagel's years in the Senate haven't endeared him to many Republican lawmakers still smarting over his outspoken criticism of the Iraq war even after he voted to authorize the U.S. invasion. Hagel's position on the war sealed his reputation as a party outsider and led him to lend tacit support to President Barack Obama during the 2008 presidential campaign.

Hagel has been criticized for opposing unilateral U.S. sanctions against Iran in the past?a position he now embraces?and calling for direct talks between Tehran and Washington without preconditions. He has also raised questions about his support for Israel and at one point criticized the "Jewish lobby? as having too much clout in Washington.

"Like each of you, I have a record. A record I am proud of, not because of any accomplishments I may have achieved or an absence of mistakes, but rather because I?ve tried to build that record by living my life and fulfilling my responsibilities as honestly as I knew how and with hard work," the former senator said.

"My overall worldview has never changed: that America has and must maintain the strongest military in the world; that we must lead the international community to confront threats and challenges together; and that we must use all tools of American power to protect our citizens and our interests. I believe, and always have, that America must engage?not retreat?in the world. My record is consistent on these points."

Hagel, who earned two Purple Hearts in Vietnam and still carries shrapnel in his chest, would be the first former enlisted soldier to head the Pentagon.

He was introduced by two retired senators with long careers on the committee: Democrat Sam Nunn of Georgia and Republican John Warner of Virginia. After a lengthy opening tribute, Warner got laughs from the room when he turned to Hagel and declared: "You're on your own. Good luck!"

CLEVELAND (AP) ? Tired, short-handed and eager to get home, the Golden State Warriors could have taken the night off.

Instead, they looked like a team that needs to be taken seriously.

Klay Thompson scored a career-high 32 points and the Warriors, playing without three starters and a key reserve, beat the Cleveland Cavaliers 108-95 Tuesday night.

The Warriors were missing guard Stephen Curry (ankle), center Andrew Bogut (ankle) and forward Harrison Barnes (knee). Also, Carl Landry, one of the first players off Golden State?s bench, didn?t play because of a shoulder injury.

In all, the Warriors were missing an average of 49.1 points and 19.5 rebounds, but that didn?t matter. Golden State shot 54 percent, including 11 for 16 on 3-pointers as it hit the first nine from beyond the arc. The Warriors took control in the second quarter and built a 16-point lead in the second half.

?No matter who is out there, we?re still going to play Warriors basketball,? said David Lee, had 20 points and 13 rebounds. ?We could have mailed it in on the last game of a road trip, but everybody stepped up with a bunch of guys out.?

The Warriors played the finale of a four-game road trip and were coming off a victory in Toronto on Monday.

?That?s a big-time win,? Golden State coach Mark Jackson said. ?That?s a statement game for us. I?m extremely proud of my guys. It would?ve been very easy to chalk one up (a loss) because we were short-handed, but I challenged them ? and they stepped up.?

Jarrett Jack, starting at point guard, had 26 points and 12 assists.

?I had to channel my inner Stephen Curry tonight,? he said.

Cavaliers guard Kyrie Irving, who missed the morning shootaround because he was sick, scored 14 points on 5-for-17 shooting in 36 minutes. Irving was coming off the best week of his career when he averaged a league-best 35.7 points in three wins, was selected as a reserve to the Eastern Conference All-Star team, and was named the conference?s player of the week on Monday.

?I just wasn?t there in terms of my mental focus,? Irving said. ?That?s no excuse. I tried to play through it, but my normal energy wasn?t there. I?m just feeling like crap.?

?He didn?t look like himself,? Cleveland coach Byron Scott said. ?I didn?t think, obviously, he was 100 percent.?

Scott warned his players before the game that the Warriors would be ready to play. It would appear they didn?t listen.

?We?ve got to treat it like a wounded animal,? he said. ?It has no choice. It?s going to come out fighting.?

?They just kicked our butts, to be honest with you,? Irving said.

Tristan Thompson had 18 points and 11 rebounds for Cleveland, and Dion Waiters also scored 18 points. The Cavaliers fell short in their bid for their first four-game winning streak since late in the 2009-10 season ? LeBron James? final year with the team.

Klay Thompson was 13 of 24 from the field, including 6 for 8 on 3s.

?It wasn?t just me,? he said. ?My teammates found me, and we just played great tonight. We didn?t have four of our premier players, but it just shows the depth of our team.?

Curry, who leads the Warriors with a 21-point average, didn?t play after twisting his right ankle Monday. Jackson said he doesn?t know how long Curry, who has had surgery on the ankle in each of the past two offseasons, will be out.

Bogut, who returned Monday after missing 38 games with an injury to his left ankle, likely won?t play in back-to-back games until after the All-Star break. Barnes, a rookie, was out with a sore left knee sustained against Toronto while Landry, a forward off the bench, was sidelined with a bruised left shoulder that also occurred Monday.

Golden State raced to a 13-4 lead less than four minutes into the game. The Cavaliers regrouped and led 27-25 in the second quarter, but the Warriors regained control.

Klay Thompson hit three 3-pointers, a jump shot and a dunk to help the Warriors build a 13-point lead twice. Golden State led 55-44 and shot 59 percent, including making all six of their 3-point attempts, in the first half.

The Warriors? continued to pull away in the third quarter when Thompson hit two 3-pointers and scored 12 points. Golden State led 84-68 going into the fourth quarter. The Cavaliers, who rallied from a 20-point deficit to defeat Milwaukee on Friday, cut the lead to 97-89 with about three minutes to play, but Jack hit a 3-pointer and another basket, pushing the lead to 102-89.

TRAIL BLAZERS 106, MAVERICKS 104: LaMarcus Aldridge hit a turnaround jumper at the final buzzer and the Blazers came back from a 21-point third-quarter deficit.

Aldridge finished with 29 points and 13 rebounds for Portland, which trailed 101-94 with 2:18 left. J.J. Hickson had a season-high 26 points and 15 rebounds.

After Wesley Matthews made two free throws to pull the Blazers to 101-98 with 52 seconds to go, Nicolas Batum?s 3-pointer tied the score.

Dirk Nowitzki answered with his own 3 with before Aldridge had a 3 to tie it at 104 with 4.9 seconds left. O.J. Mayo was called for charging with 1.5 seconds to go, and Aldridge hit his jumper after the inbound from Matthews with 0.2 seconds left for the victory.

Nowitzki finished with 26 points for Dallas, which had won six of its last eight games.

LAKERS 111, HORNETS 106: Dwight Howard had 24 points, Earl Clark added 20 points and 12 rebounds, Kobe Bryant chipped in with 14 points and Los Angeles took the win. Eric Gordon had 25 points for New Orleans.

HTC hosting events in NYC and London on Feb. 19 - 'M7' on the way?

Invites to HTC events on Feb. 19 have just arrived in our inbox -- one in London, another in New York City, both running concurrently. Looks like that rumored "M7" handset could be on the way!

We're expecting HTC to show off its latest flagship device at the pre-Mobile World Congress event. Rumored to feature internal specs and design language similar to the Droid DNA, the "M7" will be HTC's first flagship smartphone of 2013. From what we've seen leak in recent weeks, it'll also pack a completely redesigned version of the company's "Sense" UI.

HTC will be hoping that by launching its new device a week before Mobile World Congress it'll be able to stand out from the crowd of smartphones and tablets that'll be announced at that show. The timing of the events also means it'll be able to show off it's new stuff to a wider audience just a week later, and ride a separate wave of publicity out of MWC.

Diabetes drug could hold promise for lung cancer patients

Jan. 28, 2013 ? Ever since discovering a decade ago that a gene altered in lung cancer regulated an enzyme used in therapies against diabetes, Reuben Shaw has wondered if drugs originally designed to treat metabolic diseases could also work against cancer.

The growing evidence that cancer and metabolism are connected, emerging from a number of laboratories around the world over the past 10 years, has further fueled these hopes, though scientists are still working to identify what tumors might be most responsive and which drugs most useful.

Now, in a new study in the journal Cancer Cell, Shaw and a team of scientists at the Salk Institute for Biological Studies found that phenformin, a derivative of the widely-used diabetes drug metformin, decreased the size of lung tumors in mice and increased the animals' survival. The findings may give hope to the nearly 30 percent of patients with non-small cell lung cancer (NSCLC) whose tumors lack LKB1 (also called STK11).

The LKB1 gene turns on a metabolic enzyme called AMPK when energy levels of ATP, molecules that store the energy we need for just about everything we do, run low in cells. In a previous study, Shaw, an associate professor in Salk's Molecular and Cell Biology Laboratory and researcher in the Institute's new Helmsley Center for Genomic Medicine, demonstrated that cells lacking a normal copy of the LKB1 gene fail to activate AMPK in response to low energy levels. LKB1-dependent activation of AMPK serves as a low-energy checkpoint in the cell. Cells that lack LKB1 are unable to sense such metabolic stress and initiate the process to restore their ATP levels following a metabolic change. As a result, these LKB1-mutant cells run out of cellular energy and undergo apoptosis, or programmed cell death, whereas cells with intact LKB1 are alerted to the crisis and re-correct their metabolism.

"The driving idea behind the research is knowing that AMPK serves as a sensor for low energy loss in cells and that LKB1-deficient cells lack the ability to activate AMPK and sense energy loss," says David Shackelford, a postdoctoral researcher at Salk who spearheaded the study in Shaw's lab and is now an assistant professor at UCLA's David Geffen School of Medicine.

That led Shaw and his team to a class of drugs called biguanides, which lower cellular energy levels by attacking the power stations of the cell, called mitochondria. Metformin and phenformin both inhibit mitochondria; however, phenformin is nearly 50 times as potent as metformin. In the study, the researchers tested phenformin as a chemotherapy agent in genetically-engineered mice lacking LKB1 and which had advanced stage lung tumors. After three weeks of treatment, Shaw and his team saw a modest reduction in tumor burden in the mice.

Continuing the study between Salk and UCLA, Shaw and Shackelford coordinated teams in both locations to perform further testing on mice with earlier stage disease, using cutting-edge imaging technologies just like those used on lung cancer patients in the clinic. They found that early phenformin treatment causes increased survival and slower tumor progression in tumors lacking LKB1, but had no significant benefit for tumors with alterations in other lung cancer genes. This specificity in treatment fits with an emerging approach in cancer treatment nationwide, known as personalized medicine, in which the therapies for each patient are selected based on the genes altered in their tumors.

"This study is a proof-of-principle that drugs of this chemical type cause energy stress and lower ATP levels to where it kills LKB1-deficient cells without damaging normal, healthy cells," says Shaw, senior author of the study.

The Food and Drug Administration took phenformin off the market in 1978 due to a high risk of lactic acid buildup in patients with compromised kidney function, which is not uncommon among diabetics but less of an issue for most cancer patients. The issue of kidney toxicity would also be bypassed in cancer patients because the course of treatment is much shorter, measured in weeks to months compared to years of treatment for diabetes patients.

The next step is to determine if phenformin alone would be a sufficient therapy for certain subsets of NSCLC or if the drug would perform better in combination with existing cancer drugs. Based on their findings, the researchers say that phenformin would be most useful in treating early-stage LKB1-mutant NSCLC, as an adjuvant therapy following surgical removal of a tumor, or in combination with other therapeutics for advanced tumors.

"The good news," says Shackelford, "is that our work provides a basis to initiate human studies. If we can organize enough clinicians who believe in investigating phenformin -- and many do -- then phenformin as an anti-cancer agent could be a reality in the next several years."

Other researchers on the study were Laurie Gerken, Debbie S. Vasquez, and Mathias Leblanc of the Salk Institute, and Evan Abt, Atsuko Seki, Liu Wei, Michael C. Fishbein, Johannes Czernin, and Paul S. Mischel, of the David Geffen School of Medicine at the University of California, Los Angeles.

Is it time to abandon privacy? | Webdesigner Depot

Whilst the trend for online business continues to grow, there is a significant increase in the number of consumers choosing not to do business online. The most oft-quoted reason is privacy.

Six months ago, several thousand euros were charged to one of my cards. A criminal had somehow accessed my Amazon account and purchased hundreds of gift certificates for himself via amazon.de, the German language version of the retailer.

It?s clear that the weak link was my account rather than my card as all fraudulent charges appeared in my account history. Exactly how the access was gained is a mystery: I?m not exactly a newbie to the internet. Since it happened I?ve been very wary providing details to anyone, and haven?t shopped with Amazon at all. If I can be discouraged to easily, how much more off-putting must it be for the less tech-savvy? Can they be blamed for mis-trusting online purchasing?

Financial details are not the only data being exploited. Last week Google released their Transparency Report detailing the user information they have handed out at the request of courts and government agencies. Requests have increased by 70% in the last 3 years, with more than 21,000 requests in the last six months alone.

Data about you isn?t restricted to what you hand over knowingly. Numerous devices including cameras include geolocation technology. When a suspected hacker posted photos online of his girlfriend taunting the police last year, the GPS information in the photos? metadata lead federal authorities straight to her door.

Of course, the argument goes, that if you?ve done nothing wrong, you?ve nothing to fear. So what leads customers to fill out online forms with phone numbers like ?01234567890?? Why lie, what does the user have to hide? The answer is nothing, they simply don?t trust you not to lose, or sell their information.

As developers, building websites for our clients, how can we combat this climate of mistrust?

The first step, as advocated by Nathan Barry last month is to limit the amount data we ask for: do you really need a street address in order to contact someone, wouldn?t an email do?

A second, and potentially more long-term solution is to balance the exchange of information by showing the same level of trust in the user that you ask them to lend you.

It?s extremely unlikely that a customer?s survival depends on the goods or services you?re offering, your business? survival on the other hand is very much dependent on sales. The balance of need is in the customer?s favor, it makes sense therefore that the business, which has the most to gain, is the one to take the risk.

It?s time that businesses stopped offering callback forms and made themselves reachable. If a phone call may be necessary to verify a transaction then provide your phone number, don?t ask for the customer?s. If you?re genuinely worried about the cost to the consumer then provide a toll-free number.

If businesses continue to value their privacy over that of their customers they may soon find themselves so private that they have no customers at all.

As for Amazon, they refused to provide a phone number to resolve the fraud on my account. Fortunately, my bank has a branch down the road, I walked in there and they took care of it for me.

Couched in lofty rhetoric about the importance of cutting off money from special interests to politicians and other regulations favored by reformers, their proposal sought to ban the practice of using payroll deductions for political expenditures ? a popular method of union fundraising.

Once alerted to the true nature of Proposition 32, the unions and political left rose up against it.

An innocuously named nonprofit, the Iowa-based American Future Fund, proved to be one of the biggest backers of the initiative, sinking more than $4 million into the ballot measure that voters ultimately rejected.


As a ?social welfare? organization, the American Future Fund is not required to publicly disclose its donors. But to maintain its tax-exempt status under Sec. 501(c)(4) of the U.S. tax code, influencing elections cannot be its primary purpose.

The American Future Fund?s investment in California was part of a nationwide, political advertising spree in 2012 that exceeded $29 million, according to a Center for Public Integrity analysis of state and federal records.

That amount included more than $19 million on efforts designed to oust President Barack Obama, as well as millions more to oppose Democratic candidates for Congress and even two state attorneys general. Now the group is funding ads opposing Obama?s nomination of former Republican Sen. Chuck Hagel of Nebraska for defense secretary.

Since the U.S. Supreme Court?s controversial Citizens United decision in 2010, nonprofits such as the American Future Fund have played a more prominent role in electoral contests ? all while giving their supporters the ability to keep their identities hidden. During the 2010 midterm elections, politically active nonprofits outspent super PACs, which exist to fund political advertisements, by a 3-to-2 margin.

The American Future Fund ranked third among ?social welfare? nonprofits in spending in the 2012 federal election, according to the Center for Responsive Politics, trailing only the Karl Rove-affiliated Crossroads GPS and Americans for Prosperity, which is backed by conservative billionaire brothers Charles and David Koch.

There are also Democratic-aligned nonprofits, but their spending was well below that of their conservative counterparts. The top left-leaning nonprofit was the League of Conservation Voters, which reported spending about $11 million in the 2012 election opposing or supporting candidates.

The American Future Fund?s spending ?raises some serious questions? and ?evades any form of meaningful disclosure,? said Adam Rappaport, senior counsel with watchdog group Citizens for Responsibility and Ethics in Washington (CREW).

Numerous officials with the American Future Fund did not respond to requests for comment for this story.

Advocating for ?free-market ideas?
The American Future Fund?s mission is to ?educate and advocate for conservative and free-market ideas,? according to its annual filing with the Internal Revenue Service.

Despite asserting that it isn?t primarily focused on elections, the nonprofit?s DNA is decidedly political.

Conservative political operative Nick Ryan, a longtime adviser to former GOP Rep. Jim Nussle of Iowa, founded it in 2007. Over the years, the group has paid Ryan?s firm, Concordia Enterprises, hundreds of thousands of dollars annually for consulting services.

In 2010, the New York Times reported that Iowa businessman Bruce Rastetter provided an unspecified amount of ?seed money? for the organization. Ryan once represented four of Rastetter?s companies as a lobbyist, including Hawkeye Energy Holdings, one of the country?s largest ethanol producers.

The nonprofit?s first president was Nicole Schlinger, the former finance director of Iowa?s Republican Party. Its current president is veteran Republican state Sen. Sandra Greiner, who served for 14 years as the Iowa chairwoman of the pro-business American Legislative Exchange Council.

Ryan and Greiner did not respond to requests for comment.

In 2008, when the American Future Fund was seeking ? and ultimately garnered ? tax-exempt status from the IRS, it pledged to abstain from electoral politics, saying it would spend 70 percent of its time doing work to ?educate the public on policy issues? and 30 percent engaging in efforts to ?influence legislation through grassroots advocacy.?

When asked on its application if the group had any plans to spend money to ?influence the selection, nomination, election or appointment? of anyone seeking public office, it answered ?no.? It also vowed to stay out of the presidential race.

When the IRS subsequently inquired why the group?s advertisements ?appear to be more partisan than nonpartisan,? the group?s attorney, Karen Blackistone, wrote that the efforts were ?strictly issued-based and nonpartisan.?

The group takes a position on issues and encourages the public to contact their representative, she wrote in a 2008 response to the IRS.

?AFF?s advertisements have never commented on a candidate?s character, qualifications or fitness for office,? she stated.

Big money tied to post office box
The American Future Fund has raised more than $60 million, with spikes in contributions coming in election years.

Much of that money has come from another conservative ?social welfare? nonprofit that doesn?t disclose its donors by name ? the Arizona-based Center to Protect Patient Rights.

The nonprofit has no website and lists its address as a post office box in Phoenix. It was launched in 2009 by Republican operative Sean Noble, who has extensive ties to the vast political network underwritten by the Koch brothers.

Noble, a former chief of staff for former Rep. John Shadegg, R-Ariz., did not respond to requests for comment for this story.

For three years running, Noble?s organization has reported making substantial grants to the American Future Fund for ?general support,? according to IRS filings. The nonprofit contributed more than $14 million to the American Future Fund between 2009 and 2011, or 51 percent of funds the group raised over the three-year period.

The Center to Protect Patient Rights has also given millions of dollars to a network of conservative groups, including the Koch-backed nonprofit Americans for Prosperity, as was first reported by the Center for Responsive Politics.

In addition to Noble, there is another Koch connection.

In 2008, Trent Sebits, the former manager of public and government affairs for the Kochs? Wichita-based refining giant, Koch Industries, registered with the state of Kansas to lobby on behalf of the American Future Fund and Americans for Prosperity. Sebits did not respond to a request for comment.

The American Justice Partnership, another ?social welfare? nonprofit, gave $50,000 to the American Future Fund in 2011 and $2.4 million in 2010, according to IRS filings. The group supports free enterprise and is often at odds with trial lawyers.

Dan Pero, its president, said in an emailed statement that the organization supported the American Future Fund to help ?promote free enterprise and improve the fairness and predictability of the legal environment.?

Like super PACs, ?social welfare? nonprofits are allowed to accept unlimited donations from individuals, corporations, unions and other organizations. The only funders whose names they are required to publicly disclose are those that make contributions earmarked for political purposes.

That?s as it should be, according to attorney Dan Backer, who is not affiliated the American Future Fund but does work with other conservative groups.

?A nonprofit makes its decisions by a board or other management structure, which is distinct from its donors,? Backer said.

Increasingly political
In 2010, the American Future Fund became far more politically active, reporting $8.6 million in political expenditures as well as millions more for ?media services,? ?telecommunications? and ?mail service/production.? It told the Federal Election Commission that it spent $9.1 million on political advertisements.

Marcus Owens, former chief of the IRS?s nonprofits division, said it is ?difficult to conjure up a situation where a particular expenditure would be reportable to the FEC but would not constitute political campaign intervention under tax law.?

Nevertheless, Owens said the organization could make a ?straight-faced argument? that its orientation had simply changed over time to become more overtly political.

Of the $25 million that the American Future Fund reported spending to the FEC last year, more than 90 percent fueled ads that urged voters to support or reject candidates.

The group also sought the FEC?s advice on whether mentioning the White House or ?the administration? in negative ads ahead of Election Day would be seen as referring to a ?clearly identified candidate for federal office.?

Such a designation would have required the group to disclose information about its donors. (The commission deadlocked, 3-3, in a vote along party lines.)

In addition to the presidential race, the American Future Fund spent money in 20 congressional elections in 2012, including California?s 26th Congressional District, where it spent $500,000 attacking Democrat Julia Brownley, who, as a state legislator, had authored legislation to bolster disclosure for political advertisements.

She won anyway, but told the Center for Public Integrity that she is ?deeply concerned? about the activities of non-disclosing groups in the wake of Citizens United and hopes to ?take immediate action? to strengthen federal disclosure laws.

The American Future Fund also spent more than $542,000 to aid West Virginia Republican Patrick Morrisey in his successful quest to win the race for attorney general, records indicate, and more than $620,000 in a failed effort to sink Missouri Attorney General Chris Koster, a Democrat.

Complaints about the American Future Fund?s political activities have followed it since its creation.

In 2008, the Democratic Party in Minnesota contended that the group needed to register as a political committee after paying for ads that praised then-U.S. Sen. Norm Coleman, R-Minn. The FEC disagreed.

Two years later, in October 2010, consumer group Public Citizen and two other organizations alleged that the American Future Fund?s ?huge expenditures? to aid candidates in the midterm election should have triggered requirements that the group register as a political committee and disclose its donors. That complaint is still being considered by the FEC, which often takes years to fully resolve such matters.

CREW, the watchdog organization, filed a complaint against the American Future Fund with the IRS in February 2011 that challenged whether its primary purpose was something other than influencing elections. The group has dismissed the complaint as ?baseless? and contends that CREW ?only targets government officials and organizations who have a differing or conservative point of view.?

Proposition 32

California?s campaign finance rules require major donors to groups that pay for political advertisements to be named in actual ads.

Thus, when a political committee called the California Future Fund for Free Markets aired ads praising Proposition 32, each advertisement included the disclaimer ?with major funding by the American Future Fund.?

One ad criticized lawmakers for making ?deals cut in shadows and back rooms? as dramatic music played in the background. Yet the donors to the American Future Fund itself largely remain in the shadows.

Stem cell 'first aid' for rat stroke

Stem cells given in the vital period immediately after a stroke may aid recovery, suggest researchers.

Rats injected with stem cells 30 minutes after a stroke had almost normal brain function restored within a fortnight.

The Bolivian research team say the method has potential in human trials.

Current best practice is to treat many patients with "clot-busting" drugs in the "golden hour" after a stroke has taken place.

The research, published in the journal Stem Cell Research and Therapy, adds to others which have found that stem cells could aid stroke patients by boosting the body's ability to repair tissue damage.

Stem cells are the body's "master cells", with the potential to become many different cell types, and theoretically replace cells lost through disease or injury.

Recent tests in humans have show some promise, with stroke symptoms improving after an infusion of stem cells.

The Bolivian team, from La Paz University Hospital, extracted a certain type of stem cells from fat and bone marrow, then injected them into the blood vessels of rats shortly after they had suffered an artificially-induced stroke.

Even though the introduced cells did not appear to travel to the affected region of the brain, the rats still did better than other rats who did not receive the cells.

Within 24 hours, they were already showing a speedier recovery, and two weeks later, they registered almost normal scores on behavioural tests.

Easy to use

The researchers said the early introduction of the cells might even interrupt the typical "chain reaction" of tissue damage which follows a stroke, in which the initial injury harms additional cells in surrounding areas.

Dr Exuperio Diez-Tejedor, who led the research, said: "Improved recovery was seen regardless of origin of the stem cells, which may increase the usefulness of this treatment in human trials.

"Adipose (fat) -derived cells in particular are abundant and easy to collect without invasive surgery."

The ease of collection, and the ability to use "allogenic" cells from other rats rather than having to harvest the animal's own cells and culture them, meant a treatment was available not weeks after a stroke, when the damage was done, but in this case minutes.

They wrote: "From the viewpoint of clinical translation allogenic stem cells are attractive because they can be easily obtained from young healthy donors, amplified, and stored for immediate use when needed after a stroke."

They suggested that it might be possible to overcome the risk of immune rejection of the donor cells in humans.

However, a spokesman for the Stroke Association said that human trials of this particular technique would not be possible in the near future.

Dr Clare Walton said: "Stem cells are an incredibly interesting area of stroke research and the results of this study provide further insight into their potential use for stroke recovery.

"However, we are a long way off these types of treatments being used in humans and a lot more research is needed."

Lawyer: Qatar poet appeals life sentence

DOHA, Qatar (AP) ? A defense attorney says a Qatar court will decide next month on the appeal of a poet given a life sentence for a verse that allegedly opposed the Gulf emirate's ruling system.

Muhammad ibn al-Dheeb al-Ajami's case is seen as a test of how far Gulf Arab states will push a crackdown on Internet posts they consider politically threatening. They face mounting international criticism.

Najeeb al-Nauimi argues his client had no intention of challenging Qatar's emir. During a hearing Sunday, al-Ajami met directly with the presiding magistrate. A verdict is expected Feb. 25.

Al-Ajami has been jailed since November 2011, months after an Internet video was posted of him reciting "Tunisian Jasmine," lauding the 2010 popular uprising there that touched off the Arab Spring. He was sentenced last November.

Holocaust archive reunites long lost families

Nearly 70 years after the end of the Second World War, a Holocaust archive in Germany is helping victims and survivors of Nazi atrocities to find clues about the past -- and is still reuniting families. NBC News' Andy Eckardt reports from Bad Arolsen, Germany.

BAD AROLSEN, Germany -- Wilhelm Thiem may be 72 but he celebrated his first real birthday in November.

Abducted in Poland by Nazi troops at age two, Thiem has spent most of his life on a painful journey, seeking to discover his true name and identity.?

Until just a few months ago, the retired entrepreneur had not known his birth date, where he was born, what had happened to his mother or whether he had any other family members.

"I hardly knew anything about my personal history," Thiem said.?"I always felt like an outsider, it was a feeling of not belonging in this world."

Thiem was raised by a foster parent in northern Germany who was appointed by the Nazis to take care of the young child. Thiem called her "Mrs. Huebner" but was later officially adopted and given her maiden name.

At age 12, Thiem learned that Mrs. Huebner was not his real mother. He started asking her about his past, wanting to learn more about his family, but his questions remained unanswered. For decades, his personal history remained a mystery.

Early last year, Thiem came across a newspaper article about the International Tracing Service?(ITS), an organization that maintains a vast archive of files related to more than 17.5 million victims of the Holocaust and Nazi oppression.

"At first the ITS researchers told me that they could not find any documents with my name on them," Thiem recalled. "But then they contacted the Red Cross in Poland and in the end, there were some leads."

'Very emotional moment'
After several months of research, Thiem was informed that he had been born in Lodz, Poland, and that his birth name was Zbigniew Wilhelm Katmierczak.

For the first time in his life, Thiem held a birth certificate in his hands that gave him an identity.

"It was a very emotional moment," Thiem recalled. "Both my wife and I could not hold back tears."

Researchers revealed that his mother was also sent to Germany as a forced laborer but later returned to Poland. She eventually married a Frenchman and relocated to France.

Thiem was also told of a surviving aunt, who still lives in his Polish hometown.

He is now anxiously making plans for a trip to Lodz with his wife for a very special family reunion.

"I am hoping to learn more facts, maybe find other family members," Thiem said. "Maybe I can find traces of my mother and father.?All of this is of huge interest to me, it means so much."

Established by Allies in the final days of the Second World War and originally run by the Red Cross, the ITS helps to uncover the fates of Holocaust victims and others who suffered under the Nazi regime.

The archive in Bad Arolsen is said to be the largest storage facility of documents related to the Holocaust. It includes 30 million documents in 16 miles of shelves housing information about Holocaust survivors, displaced persons, slave laborers and political refugees from former Eastern Bloc countries.

Over the past 50 years, the ITS has answered more than 10 million requests. About 1,000 search requests continue to trickle in to the archive monthly.

"Many people still do not know what has become of their loved ones,"?said Dr. Ingeborg Berggreen-Merkel from Germany's federal commission of culture. "Even decades after the end of the Holocaust and the war, there is this persisting uncertainty, which results from the fact that part of one's own history remains untold."?

Visitors to the archive come into direct contact with the bureaucracy of mass murder.

Its meticulous records include concentration camp files, "deportation cards," patient records and a post-war index of non-German citizens. Its researchers plow through the stacks of yellowing paper, registering and scanning as many of the historic documents as possible. More than 95 percent have now been digitized.

But due to concerns about the victims' privacy, the ITS and the German government kept the files closed to the public for half a century. While search requests have been accepted since the end of the war, the archive was initially not "open source."

Following public pressure from survivor groups, historians and researchers, who called for public access to the archives, the ITS Commission -- consisting of 11 member states -- declared itself in favor of opening up Bad Arolsen in 1998.

Yet, scholars and researchers were only given access to the documents beginning in 2007.

"I think it was criminal that the documents were not opened up earlier," said Holocaust survivor and U.S. judge Thomas Buergenthal. He was able to find?records of his father's ordeal in the concentration camps of Auschwitz, Sachsenhausen and Buchenwald at Bad Arolsen.

"This archive is my father's only memorial, we have no other," Buergenthal added.

But although time has claimed many eyewitnesses, the archive is still helping to reunite survivors of Nazi terror -- such as Thiem and his long lost aunt. She remembers her nephew -- who is now an elderly man -- as a "little child."

"I spent a lifetime wondering who I really am, now I know," Thiem said.

Antigua could hit U.S. with copyright-free downloads

GENEVA (Reuters) - The tiny Caribbean nation of Antigua and Barbuda will tell the World Trade Organization on Monday that it intends to use trade sanctions against the United States, which it could enforce by allowing movie downloads without protecting U.S. copyright.

Antigua has the right to do so because it won a WTO legal case, first launched in 2003, against a U.S. ban on online gambling. The United States then said it would no longer apply WTO rules to gambling but failed to offer Antigua comparable access in other services, as it should have.

Antigua won the right to hit back with trade sanctions and - with little hope of persuading Washington by threatening to block U.S. imports to the nation of 70,000 - it was given permission to use intellectual property instead.

"American intellectual property rights holders are fighting piracy across the globe. They hate the theft of their intellectual property rights and they spend enormous sums trying to prevent it," Mark Mendel, a lawyer representing Antigua in the case, told Reuters.

He declined to say exactly how Antigua might act, but said it could include copyrights, patents or trademarks.

A website that allowed users to download U.S. software or movies without paying anything to the copyright holders was one possibility, as was selling Manchester United T-shirts - the soccer club is owned by the American Glazer family.

"If, when, how it's going to happen, people will just have to wait to find out."

Although the WTO awarded Antigua the right to impose only $21 million in annual sanctions, Mendel said the size of the award was not an obstacle.

If Antigua were to begin a state-sponsored website to download Hollywood movies and U.S.-made computer software, it could still inflict a lot of damage on U.S. rights holders.

"When you think about it, $21 million could be all accomplished in one go or in 50 million goes. The dollar figure is not important," he said.

Asked if a site charging one cent per download would be a way to accomplish Antigua's aims, he said: "That is an intellectual possibility."

The WTO gave Antigua the right to retaliate with sanctions in December 2007 and it announced last month that it had finally given up waiting for a U.S. compromise proposal. The government hoped the threat of sanctions would break the logjam, Mendel said.

"We've heard a lot more from them (the U.S. negotiators) over the past two weeks than over the past 10 years." He added that Antigua's main aim was still to get the United States to comply.

In an emailed reply to a request for comment, a spokeswoman for the U.S. Trade Representative said: "The U.S. is in ongoing discussions with Antigua in an effort to find a mutually satisfactory resolution to this dispute."

The United States should be worried about other WTO members following Antigua and using the same tactic to get their way in trade disputes, Mendel said.

"If they aren't worried enough about Antigua they should be worried about someone else coming along. If we do something inventive that could pose a lot of problems for intellectual property holders, if we create that precedent, the consequences could be enormous," he said.

"With Antigua, it's $21 million. Maybe with China it's going to be $21 billion," said Mendel.

"One of the messages we want to get across is that the WTO was sold to smaller countries as a level playing field and a way for them to expand the reach of commerce, subject to a set of rules that apply to everybody. I think more than anything else this case is about fairness. The WTO is supposed to be fair."

3-D fireworks of a star: Astronomers reconstruct journey of emitted gas

Jan. 24, 2013 ? In 1901 the star GK Persei gave off a powerful explosion that has not stopped growing and astonishing ever since. Now a team of Spanish and Estonian astronomers has reconstructed the journey of the emitted gas in 3D which, contrary to predictions, has hardly slowed down its speed of up to 1,000 km/s after all this time.

Thanks to the images captured from the Isaac Newton Telescope and the Nordic Optical Telescope in La Palma (Canary Islands, Spain), a European team of astronomers has constructed a three dimensional map of the remnant of a nova, or in other words, what was left of the star after its explosion. The results have just been published in the Astrophysical Journal.

The protagonist of this story is the star GK Persei situated at 'just' 1,300 light years away from Earth. It is also known as Nova Persei 1901 because a strong thermonuclear eruption occurred on its surface on the 21st February 1901. On that day astronomers observed how its brightness suddenly increased to such an extent that it became one of the brightest stars in the skies.

The surprising thing is that the explosion created remaining material made up of gaseous knots, which become visible in 1916. "From then the visual spectacle has been similar to that of a firework display seen in slow motion," claims Miguel Santander, researcher at Spanish National Observatory and coauthor of the study.

After patient work to gather images, the team was able to measure the movements of more than 200 knots as well as the radial velocity using the Doppler effect, which allows to determine if they are getting closer or moving further away from us. In this way the 3D map of the nova was created and its dynamic was analysed.

"Such data are rarely available in astrophysics because as a general rule apparent expansion or, in other words, in the layout of the sky, the majority of objects cannot be seen," outlines another of the authors, Romano Corradi, from the Astrophysics Institute of the Canary Islands.

An unexpected result

In any case, the main result of this work "is that the gas seems to be moving further away in a ballistic or free manner and is hardly slowing down, contrary to what was thought in previous studies," comments the lead author of the investigation, Tiina Liimets of the Tartu Observatory in Estonia.

Until now it was thought that the gas from the explosion would slow down "significantly" due to the large quantity of matter in its path that the star has expelled previously. However, its speed has remained between a range of 600 and 1000 kilometres per second.

Long before the explosion in 1901, more than one hundred thousand years ago, GK Persei had already undergone a massive transformation from a red giant to a white dwarf. This process expelled its external layers forming a planetary nebula, which is a giant gas cloud within which the nova is now growing in 3D.

WASHINGTON (Reuters) - President Barack Obama urged the Senate on Thursday to confirm without delay his appointment of Mary Jo White to head the Securities and Exchange Commission and his renomination of Richard Cordray as chief of the Consumer Financial Protection Bureau.

Obama, in announcing the staff decisions at the White House, put particular pressure on lawmakers to approve Corday, saying "there's absolutely no excuse for the Senate to wait any longer."

Cordray, a former Ohio attorney general, was appointed in January 2012 while Congress was in recess after Republicans who were wary of the CFPB's independence blocked his nomination. The controversial appointment limited the amount of time Cordray could serve without going through a full confirmation process.
