It is on this health care proxy form that the child?s address was previously provided by the patient for only that reason, and which is where the rehab chose to obtained and utilize the child?s address from for purposes other than the intended purpose of needing an address on a health care proxy.
5) The patient?s children were not joint on any accounts of their elderly parent. They were only listed as beneficiaries for the checking & savings account, and also as beneficiaries on her small (only a few thousand dollar) life insurance policy.
6) The total funeral costs exceeded the total of the life insurance policy amount combined with the total amount of remaining assets which were left in the patient?s bank account prior to her passing.

The rehab also knew that the patient only had two sources of monthly income - her one and only pension amount and social security, both of which were direct deposited into her checking account, and for which the rehab was made aware of those actual amounts as well as account balance. As such, the rehab had the information about the patient's financial status and were cognizant of what little monies she had available.
8) The patient passed away passed on Tuesday, 3/20/12.
9) The death certificate was provided to the patient?s family members from the funeral home on Thursday, 3/22/12.
10) The death certificate was provided to patient?s bank the same day (3/22) by the patient?s children (i.e. beneficiaries).
11) The bank stated to beneficiaries on 3/22 that there was a required "waiting period" of up to 5 -7 days. The patient?s beneficiaries were led to believe that was necessary for the purpose of ensuring that there were no liens or outstanding debts for which the bank would have been legally bound to hold back and/or not release monies from the patient?s account to the beneficiaries.
12) Funeral home expenses were incurred from the date of the patient?s passing (3/20) thru the date of burial, which was Friday, 3/23.
13) The bank called the beneficiaries on Monday, 3/26/12 and let each of them know that the monies in the patient?s account had cleared and were available to be released to beneficiaries.
14) Despite the rehab having been verbally apprised as well as having been presented with written information in the form of copies of documents, and thereby aware of all of this, and despite them having already been told that the patient?s children did not have POA for the patient?s affairs, the rehab still, for whatever reason, chose to send a statement for the patient's account to one of her children where they lived.

The amounts reflected on the rehab?s statement are for Medicare co-payments for all days at that rehab which were under the first 100 days of Medicare. Samsung will introduce an LED television with an integrated free-to-air satellite receiver, the Samsung LED TV Free Satellite, that will be distributed in Nigeria, Ghana, Cote D?Ivoire, Senegal, Democratic Republic of Congo and Cameroon in August 2012. Distribution to additional countries will follow.

The integrated satellite receiver will allow consumers to receive free-to-air television channels without the need for an additional set top box as the LED TV will be directly connected with the satellite dish. In preparation for the launch, SES and Samsung will jointly arrange training sessions with distribution partners and installers to ensure the proper connection of the TV device to the satellite dish. Both partners will also run a joint marketing campaign in June 2012.

Erika Van Pelt delivered a fine performance Wednesday, but she still got the boot this week.

Maybe promoting Erika Van Pelt's extreme makeover wasn?t such a great idea for the "American Idol" hopeful Wednesday.

Sporting her new Kris Jenner-Kardashian hairdo and receiving some newfound praise from the judges still couldn?t get Van Pelt a trip to the ?Idol? mansion. She was voted off the show Thursday night, finishing in 10^th place.

Her elimination wasn?t a surprise. Van Pelt had been among the lowest vote-getters every week, and it wasn?t because of her looks. In fact, the new image might have hurt, since there was so much focus on the drastic hairstyle change instead of how she sang. She was nothing but fun to the end, however, running back to her old seat to get a pair of tiny maracas so at least she could party a little bit while awaiting her fate.

Also having a rough night was Heejun Han. He was in the bottom three, heard Steven Tyler?s snarky feedback get replayed again and had Jimmy Iovine say, ?I think [Steven] felt that Heejun came and disrespected the entire process,? and later compared his performance to an Adam Sandler direct-to-video production. ?It?s safe to say that Han can?t count on an Interscope recording contract if he doesn?t win this.

Then J.Lo told Han, "I think you are a star. I don't think you should sell yourself short, ever." And I'm sure he'd rather have her in his corner than any of the guys. But it looks like both Jimmy and Steven are ready to see him go.

Also in the bottom three was DeAndre Brackensick. His ?Only the Good Die Young? was the worst of the night Wednesday, but not bad enough to drop below Van Pelt?s smaller fanbase.

She fully expected to be there again after being called upwith Skylar Laine and Hollie Cavanagh. Instead, host?Ryan Seacrest first sent Laine and Canavagh back to safety, and then gave Testone the surprising news that at least for this week, she could relax as well.

Haley Reinhartwas one of the guest performers (along with Lana Del Rey), and could serve as an inspiration to Testone. A year ago, Reinhart was in the bottom three in each of the first two weeks of the finals, but then found her niche, got a solid fan club going and wound up finishing third. It can be done.

Whether or not Testone can do it, we?ll see. But Jimmy noted that when Testone sang, ?I got goosies. I don't really know what goosies are. But I felt something." (Please, for the love of all things sacred Jimmy, don?t encourage J.Lo to use the "G" word more often.)

Stocks slip, adding prior day?s drop

U.S. stocks slipped Friday after equities suffered their worst percentage drop in two weeks, with the S&P 500 on track for its first decline in the past six weeks.

The S&P lost 0.7 percent on Thursday, its biggest percentage drop since March 6. The benchmark index is still near four-year highs.

The benchmark S&P is down 0.8 percent for the week, and many investors were waiting for a further pullback as the index has risen 10.8 percent for the year and 26.7 percent from its October low.

Indexes could get a boost next week from quarter-end "window dressing" as fund managers drop poor performing stocks and chase better-performing ones.

Factory data showing a slowdown in both the euro zone and China sent the S&P 500 lower on Thursday to its first close closed below 1,400 in six sessions.

"Today investors are basically going to focus on the domestic economy, so new home sales could re-energize the upward trend," said Peter Cardillo, chief market economist at Rockwell Global Capital in New York.

Zynga Inc dipped 1.9 percent to $13.50 in premarket trade after the online games maker said shareholders will sell about 43 million shares in a secondary offering.

Nike Inc was flat at $111 in premarket after the sportswear retailer forecast a strong year and said it was heading into the spring quarter with strong demand and improving margin trends.

Jobs search website Monster Worldwide Inc is open to selling all or part of itself and expects to have data ready for potential buyers fairly soon, Chief Executive Sal Iannuzzi said in an interview. Shares gained 1.8 percent to $9.66 premarket.

Darden Restaurants Inc posted higher third-quarter profit, boosted by increased sales at its Olive Garden chain.

European equities retreated further after four straight sessions of declines, stalked by concerns over the global growth outlook.

Asian shares fell after data showing shrinking factory activity in China and the euro zone heightened concerns about a slowdown in the global economy.

The University of Houston (UH) has invited a noted professor in the history of medicine, Alexandra Stern, to give the John P. McGovern Endowed Lecture in Family, Health and Human Values at 7 p.m., Monday, April 9 at the Rockwell Pavilion in the M.D. Anderson Library.

"The College of Liberal Arts and Social Sciences (CLASS) at the University of Houston is very pleased to have Dr. Stern as the 2012 McGovern Lecturer in Family, Health, and Human Values," said Catherine Patterson, associate dean of graduate studies and professor of history. "A leading expert in the history of genetics, Dr. Stern has explored a range of topics from eugenics policies in early 20th-century America to the ethical implications of the Human Genome Project. Her work investigates how health policy decisions impact individuals and families while exploring the ethical questions underlying those policies. Her current work on genetic testing is both timely and important. As medicine rapidly pushes the boundaries of what is possible, it prompts new questions about the social and ethical implications of medical advancements."

Stern will present "Don't Reduce Me to a Label: Disability Rights, Genetic Diagnosis, and Social Values." She will speak on the origins of genetic counseling in the 1940s and discuss how the first generation of medical geneticists stigmatized people with disabilities, while simultaneously laying the groundwork for empowerment and activism. Her presentation will trace this tension over the course of the 20th-century, as medical geneticists and genetic counselors became increasingly supportive of people with disabilities and the disabilities rights movement.

Stern is the Zina Pitcher Collegiate Professor in the History of Medicine at the University of Michigan. She is the author of "Eugenic Nation: Faults and Frontiers of Better Breeding in Modern America," which won the America Public Health Association's Arthur Viseltear Award for outstanding contribution to the history of public health. Her forthcoming book, from which the talk is draw, "Telling Genes: The Story of Genetic Counseling in America," will be published by John Hopkins University Press in September 2012.

The John P. McGovern Endowment was established in 1999 and supports the John P. McGovern Annual Award Lectureship in Family, Health, and Human Values in CLASS at UH. This series focuses on speakers with notable expertise in the area of family, health and human values. Each speaker is presented with the John P. McGovern Award Medal.
